Terms of Service

These Terms include an arbitration agreement and a class-action waiver in Section 22 that affect how disputes are resolved. You can opt out of arbitration within 30 days of first accepting these Terms. Please read that section carefully.

These Terms of Service (“Terms”) are a contract between you and RouteRally (“RouteRally,” “we,” “us,” “our”). They govern your use of the RouteRally website, app, and services (the “Service”). By creating an account, placing an order, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use RouteRally

You must be at least 18 years old (or the age of majority where you live), able to enter into a binding contract, and able to use a valid payment card. By using the Service you confirm this is true and that the information you give us is accurate and current.

2. What RouteRally is and isn’t

RouteRally combines nearby orders from a partner restaurant into a single, pooled delivery so the group can unlock a shared discount. RouteRally is not a restaurant and does not cook, prepare, or package food. The partner restaurant prepares your food and is responsible for it. RouteRally arranges ordering, payment, and delivery, and may also offer complimentary samples and packaged add-on products as described in Sections 11 and 12.

5. Brand pools

Some pools, discounts, or products may be supported by brand partners. When a pool is sponsored, we show this in the Service (for example, “This order is sponsored by” with the sponsor’s name). Sponsorship does not change the price you are shown before you order, and you are never charged for a sponsorship. Brands do not receive your contact information without your consent. See our Privacy Policy for how sponsor-related information is handled.

RouteRally does not require tips, and no tip is added to your order by default. If the Service offers an optional way to tip, any tip you choose is voluntary and is shown to you before you confirm. The absence of a tip never affects whether your order is prepared or delivered.

10. Food, allergens, and safety

The restaurant prepares your food and is responsible for its quality, safety, and accuracy, including allergen and ingredient information. RouteRally does not prepare food and cannot guarantee that any item is free from a particular allergen or meets a specific dietary need. If you have a food allergy or dietary restriction, check with the restaurant before ordering. You order at your own risk in this respect.

11. Free samples and partner products

From time to time, your order may include complimentary product samples provided by third-party brands (“sample products”). These are provided at no charge and are optional to use.

12. Add-on products

The Service may let you buy packaged consumer products (“add-on products”) to be delivered along with your pooled order. Add-on products are different from restaurant food.

14. Friends and social features

Some features let you connect with friends, see when a friend is in a pool, share deals, and ask a friend to pick up your order. If you use these features, certain information, such as your name and the fact that you are in a particular pool, will be visible to the friends you connect with. Only connect with people you trust, and do not share others’ information.

15. Your content and feedback

The Service may let you submit content, including ratings, comments, and reviews of sample products or the Service (“your content”). You keep ownership of your content. By submitting it, you give RouteRally a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and display it to operate and improve the Service.

Feedback you submit about sample products and partner products may be shared with the relevant sponsor or brand and used to improve products and the Service, in aggregated or anonymized form. We do not share your name or contact information with a sponsor along with your feedback without your consent. Do not submit content that is unlawful, infringing, or that includes another person’s private information.

16. Our intellectual property

The Service, including its software, design, text, graphics, and the RouteRally name and logo, is owned by RouteRally or its licensors and is protected by law. We give you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as allowed by these Terms or applicable law. Restaurant names, brand names, and logos shown in the Service belong to their respective owners and are used with permission.

17. Promotions, referrals, and credits

We may offer promotions, referral rewards, founding-member perks, or account credits. Any such offer may have its own rules, which we will make available at the time. Unless stated otherwise, promotions and credits have no cash value, cannot be combined, are non-transferable, and may be changed or ended at any time. We may withhold or reverse rewards obtained through fraud, abuse, or violation of these Terms.

The Service relies on third parties (for example, our payment processor and text-message provider) and may link to third-party websites or products. We are not responsible for third-party services or content, and your use of them may be governed by their own terms and privacy policies.

19. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent allowed by law. We do not promise the Service will always be uninterrupted or error-free, and we are not responsible for the food itself, which is prepared by the restaurant, or for sample and add-on products, which are made by their manufacturers.

20. Limit on our liability

To the fullest extent allowed by law, RouteRally is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability to you for any claim relating to the Service or an order is limited to the amount you paid for the order that gave rise to the claim. Some places do not allow these limits, so parts of this may not apply to you.

21. You cover us for your misuse

To the extent allowed by law, you agree to cover (“indemnify”) and hold harmless RouteRally and its officers, employees, and agents from claims, losses, liabilities, and costs (including reasonable legal fees) that arise from your misuse of the Service, your content, your violation of these Terms, or your violation of any law or the rights of another person.

22. Dispute resolution and arbitration

Please read this section carefully. It affects your legal rights, including your right to bring a lawsuit in court and to have disputes decided by a jury or as part of a class action.

Informal resolution first

Most concerns can be resolved quickly. Before starting arbitration, you agree to contact us at groupdealdelivery@gmail.com with a description of the dispute and give us 60 days to try to resolve it informally.

Binding individual arbitration

If we cannot resolve a dispute informally, you and RouteRally agree to resolve any dispute relating to these Terms or the Service through final and binding individual arbitration, rather than in court, except as noted below. Arbitration will be administered by a recognized arbitration provider under its consumer arbitration rules, and the Federal Arbitration Act governs this section. An arbitrator, not a court, decides threshold questions about the scope or enforceability of this arbitration agreement.

Class-action waiver

You and RouteRally agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class proceeding.

Small-claims carve-out

Either party may bring an individual claim in small-claims court if it qualifies. Nothing in this section prevents either party from seeking to stop actual or threatened infringement or misuse of intellectual property in court.

30-day right to opt out

You can opt out of this arbitration agreement (Section 22) within 30 days of first accepting these Terms by emailing groupdealdelivery@gmail.com with your name and the email on your account and the words “Arbitration Opt-Out.” If you opt out, disputes will be resolved in the courts described in Section 24, and the rest of these Terms still apply.

If part of this section is unenforceable

If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court rather than in arbitration, and the rest of this section still applies.

23. Changes, suspension, and termination

24. Governing law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws rules. Subject to Section 22, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Illinois, and you consent to their jurisdiction.
