Terms of Service

These Terms of Service (“Terms”) are a contract between you and RouteRally (“RouteRally,” “we,” “us,” “our”). They govern your use of the RouteRally website, app, and services (the “Service”). By creating an account, placing an order, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use RouteRally
You must be at least 18 years old (or the age of majority where you live), able to enter into a binding contract, and able to use a valid payment card. By using the Service you confirm this is true and that the information you give us is accurate and current.
2. What RouteRally is and isn’t
RouteRally combines nearby orders from a partner restaurant into a single, pooled delivery so the group can unlock a shared discount. RouteRally is not a restaurant and does not cook, prepare, or package food. The partner restaurant prepares your food and is responsible for it. RouteRally arranges ordering, payment, and delivery, and may also offer complimentary samples and packaged add-on products as described in Sections 11 and 12.
3. Your account
- You are responsible for keeping your login secure and for everything that happens under your account.
- Give us accurate information and keep it current, especially your delivery details and phone number.
- Tell us right away if you think someone else is using your account.
- You may close your account at any time. We may decline service, or suspend or close an account, as described in Section 23.
4. How ordering and pools work
- When you place an order, it joins a “pool” with other nearby orders from the same restaurant for the same delivery.
- Each pool has an order-by cutoff time. After the cutoff, the pool closes and no new orders can join.
- The discount depends on how many orders are in the pool at the cutoff. More orders can mean a bigger discount. The discount is not guaranteed and can vary.
- A restaurant may set a minimum pool size. If a pool does not reach the minimum by the cutoff, the pool may be cancelled and you will not be charged.
5. Brand pools
Some pools, discounts, or products may be supported by brand partners. When a pool is sponsored, we show this in the Service (for example, “This order is sponsored by” with the sponsor’s name). Sponsorship does not change the price you are shown before you order, and you are never charged for a sponsorship. Brands do not receive your contact information without your consent. See our Privacy Policy for how sponsor-related information is handled.
6. Prices, holds, and payment
- When you place an order we may place a temporary hold (authorization) on your card for the price shown at that time. You are not charged then.
- You are charged when the pool closes and the final group discount is locked in. The final food charge will never be more than the amount shown when you ordered, and may be less if more people joined.
- By placing an order you authorize RouteRally to charge your card for the final amount through our payment processor.
- Prices for food include the cost of the food and any applicable taxes. RouteRally does not add delivery fees, service fees, or card processing fees. All charges are shown to you before you order.
- Charges for packaged add-on products (Section 12) are separate from the food charge and may appear as a separate line item or a separate charge.
- Comparison and strikethrough pricing: where we show a crossed-out or comparison price (for example, an estimate of what the same order would cost on a standard delivery app, or a higher tier price before a group discount), that figure is an illustration of typical alternative pricing or a pre-discount amount. It is not necessarily a former RouteRally price, and actual prices vary by restaurant, app, time, and pool size.
- Ownership of the food: the restaurant is the seller of the food. Ownership of the food passes from the restaurant to you at the restaurant, and RouteRally never takes ownership of it. RouteRally arranges payment and delivery only.
7. Tips
RouteRally does not require tips, and no tip is added to your order by default. If the Service offers an optional way to tip, any tip you choose is voluntary and is shown to you before you confirm. The absence of a tip never affects whether your order is prepared or delivered.
8. Cancellations and refunds
- You can cancel your order any time before the pool’s cutoff. When you cancel before the cutoff, any hold on your card is released and you are not charged.
- Once a pool has closed and been charged, orders generally cannot be cancelled, because the food is being prepared.
- If a pool is cancelled (for example, it did not reach the minimum), you are not charged.
- Refunds for packaged add-on products are described in Section 12.
- If something goes wrong with your order, contact us at groupdealdelivery@gmail.com and we will work with you and the restaurant in good faith.
9. Delivery and risk of loss
- Delivery times shown in the Service are estimates, not guarantees.
- You are responsible for giving an accurate drop-off location and being reachable to receive your order.
- Responsibility for an order passes to you when it is delivered to the drop-off location you provided or otherwise following your delivery instructions (for example, left at a building lobby or front desk). After that point, RouteRally is not responsible for an order that is lost, taken, or spoiled.
- If you arrange for a friend to pick up your order through the Service, you are responsible for that choice.
10. Food, allergens, and safety
The restaurant prepares your food and is responsible for its quality, safety, and accuracy, including allergen and ingredient information. RouteRally does not prepare food and cannot guarantee that any item is free from a particular allergen or meets a specific dietary need. If you have a food allergy or dietary restriction, check with the restaurant before ordering. You order at your own risk in this respect.
11. Free samples and partner products
From time to time, your order may include complimentary product samples provided by third-party brands (“sample products”). These are provided at no charge and are optional to use.
- Sample products are made, packaged, and labeled by the named brand, not by RouteRally or the restaurant. The manufacturer of a sample product is responsible for its safety, quality, and labeling.
- Sample products may contain allergens or ingredients that do not suit everyone. Always check the product’s own label before consuming or using it. If you have an allergy or sensitivity, do not use a sample unless its label confirms it is safe for you.
- RouteRally does not include age-restricted products (such as alcohol, tobacco, nicotine, or cannabis products) as samples.
- RouteRally makes no warranty about any sample product and is not responsible for it. Any concern about a sample product should be directed to its manufacturer, and you may also let us know at groupdealdelivery@gmail.com.
12. Add-on products
The Service may let you buy packaged consumer products (“add-on products”) to be delivered along with your pooled order. Add-on products are different from restaurant food.
- Add-on products are sold as packaged by their manufacturer. They are not prepared by the restaurant, and no restaurant is involved in that part of the transaction.
- Add-on products are sold in the condition supplied by the manufacturer. Any warranties come from the manufacturer. To the extent allowed by law, RouteRally makes no separate warranty about an add-on product, and manufacturer labeling (including ingredients and allergens) governs.
- Charges for add-on products are separate from your food charge, as described in Section 6, and any applicable sales tax is calculated on the add-on product.
- Refunds: if an add-on product arrives damaged, incorrect, or missing, contact us at groupdealdelivery@gmail.com within 7 days and we will refund or replace the affected item. Because these are consumable goods, we generally cannot accept returns of opened or used products except where required by law.
13. Acceptable use
- Do not use the Service for anything unlawful, fraudulent, or abusive.
- Do not resell orders, manipulate pools, or interfere with the Service or other users.
- Do not misuse other people’s information you may see through the friends or pickup features.
- Do not attempt to access the Service in an unauthorized way, or to copy, scrape, reverse engineer, or disrupt it.
- Do not falsely or fraudulently claim that an order or items were missing, incorrect, poor quality, or never delivered, and return any order mistakenly delivered to you if we ask.
- Do not falsely or fraudulently dispute a card charge or request a chargeback for a charge you actually authorized. If you have a problem with an order, contact us first and we will make it right in good faith.
- Do not abuse promotions, referral rewards, or credits, including by creating multiple accounts to claim offers meant for new or individual users, or by redeeming offers you are not eligible for.
14. Friends and social features
Some features let you connect with friends, see when a friend is in a pool, share deals, and ask a friend to pick up your order. If you use these features, certain information, such as your name and the fact that you are in a particular pool, will be visible to the friends you connect with. Only connect with people you trust, and do not share others’ information.
15. Your content and feedback
The Service may let you submit content, including ratings, comments, and reviews of sample products or the Service (“your content”). You keep ownership of your content. By submitting it, you give RouteRally a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and display it to operate and improve the Service.
Feedback you submit about sample products and partner products may be shared with the relevant sponsor or brand and used to improve products and the Service, in aggregated or anonymized form. We do not share your name or contact information with a sponsor along with your feedback without your consent. Do not submit content that is unlawful, infringing, or that includes another person’s private information.
16. Our intellectual property
The Service, including its software, design, text, graphics, and the RouteRally name and logo, is owned by RouteRally or its licensors and is protected by law. We give you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as allowed by these Terms or applicable law. Restaurant names, brand names, and logos shown in the Service belong to their respective owners and are used with permission.
17. Promotions, referrals, and credits
We may offer promotions, referral rewards, founding-member perks, or account credits. Any such offer may have its own rules, which we will make available at the time. Unless stated otherwise, promotions and credits have no cash value, cannot be combined, are non-transferable, and may be changed or ended at any time. We may withhold or reverse rewards obtained through fraud, abuse, or violation of these Terms.
18. Third-party services
The Service relies on third parties (for example, our payment processor and text-message provider) and may link to third-party websites or products. We are not responsible for third-party services or content, and your use of them may be governed by their own terms and privacy policies.
19. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent allowed by law. We do not promise the Service will always be uninterrupted or error-free, and we are not responsible for the food itself, which is prepared by the restaurant, or for sample and add-on products, which are made by their manufacturers.
20. Limit on our liability
To the fullest extent allowed by law, RouteRally is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability to you for any claim relating to the Service or an order is limited to the amount you paid for the order that gave rise to the claim. Some places do not allow these limits, so parts of this may not apply to you.
21. You cover us for your misuse
To the extent allowed by law, you agree to cover (“indemnify”) and hold harmless RouteRally and its officers, employees, and agents from claims, losses, liabilities, and costs (including reasonable legal fees) that arise from your misuse of the Service, your content, your violation of these Terms, or your violation of any law or the rights of another person.
22. Dispute resolution and arbitration
Please read this section carefully. It affects your legal rights, including your right to bring a lawsuit in court and to have disputes decided by a jury or as part of a class action.
Informal resolution first
Most concerns can be resolved quickly. Before starting arbitration, you agree to contact us at groupdealdelivery@gmail.com with a description of the dispute and give us 60 days to try to resolve it informally.
Binding individual arbitration
If we cannot resolve a dispute informally, you and RouteRally agree to resolve any dispute relating to these Terms or the Service through final and binding individual arbitration, rather than in court, except as noted below. Arbitration will be administered by a recognized arbitration provider under its consumer arbitration rules, and the Federal Arbitration Act governs this section. An arbitrator, not a court, decides threshold questions about the scope or enforceability of this arbitration agreement.
Class-action waiver
You and RouteRally agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class proceeding.
Small-claims carve-out
Either party may bring an individual claim in small-claims court if it qualifies. Nothing in this section prevents either party from seeking to stop actual or threatened infringement or misuse of intellectual property in court.
30-day right to opt out
You can opt out of this arbitration agreement (Section 22) within 30 days of first accepting these Terms by emailing groupdealdelivery@gmail.com with your name and the email on your account and the words “Arbitration Opt-Out.” If you opt out, disputes will be resolved in the courts described in Section 24, and the rest of these Terms still apply.
If part of this section is unenforceable
If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court rather than in arbitration, and the rest of this section still applies.
23. Changes, suspension, and termination
- We may change the Service or these Terms. If we make material changes, we will give reasonable notice (for example, in the app or by email), and your continued use means you accept the updated Terms.
- We may suspend or close accounts that violate these Terms or misuse the Service, and we may decline or cancel an order. This includes accounts involved in fraud, abuse, or repeated bad-faith refund claims or chargebacks. Where a chargeback is filed in bad faith on a charge you authorized, we may contest it and may recover amounts and costs owed to the extent allowed by law.
- You can stop using the Service and close your account at any time. Sections that by their nature should survive (such as payment obligations, disclaimers, liability limits, indemnity, and dispute resolution) survive termination.
24. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws rules. Subject to Section 22, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Illinois, and you consent to their jurisdiction.
25. General terms
- Entire agreement: These Terms, together with any policies referenced here (including our Privacy Policy), are the entire agreement between you and RouteRally about the Service and replace any earlier agreements on that subject.
- Severability: If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver: If we do not enforce a right, that is not a waiver of it.
- Assignment: You may not assign these Terms without our consent. We may assign them, for example in connection with a merger, sale, or reorganization.
- Force majeure: We are not responsible for delays or failures caused by events beyond our reasonable control.
- Electronic communications: You agree we may communicate with you electronically (in the app, by email, or by text), and that electronic agreements and notices satisfy any legal requirement that such communications be in writing.
- Notices: We may give you notice through the Service or to the email or phone number on your account. You can reach us at the contact below.
